What is the Whistleblower Channel?
The Whistleblower Channel is an internal information channel that forms part of the internal information system that SOCIB has implemented in compliance with the requirements imposed by Law 2/2023 on the protection of persons who report regulatory infringements and combat corruption.
All individuals who, in one way or another, participate in the management and development of the activities carried out by SOCIB must comply with the obligations corresponding to each one and be committed to the proper functioning of SOCIB.
With this goal, the Whistleblower Channel is available to all those involved in its proper operation. That is to say, the Whistleblower Channel is available for:

Individuals who are employees or work on behalf of others.

Participants and persons belonging to the administrative, directive, or supervisory body of the organization, including non-executive members.

Any person working for or under the supervision and direction of contractors, subcontractors, and suppliers.

Those who communicate or publicly disclose information on infringements obtained within the framework of a labor or statutory relationship that has ended, volunteers, interns, and workers in training periods regardless of whether they receive remuneration or not, as well as those whose labor relationship has not yet begun, in cases where the information about infringements was obtained during the selection process or pre-contractual negotiation.
The purpose of the Whistleblower Channel is exclusively to report any of the following behaviors, provided they are carried out in the name and representation of SOCIB or the exercise of the activities carried out by SOCIB, or on occasion of the same:

Actions or omissions that may constitute a severe criminal or administrative offense. In any case, all those serious or very serious criminal or administrative offenses that involve economic harm to the Public Treasury and Social Security will be included here.

Actions or omissions that may constitute an infringement of European Union Law in areas such as public procurement, services, products, and financial markets, and prevention of money laundering and financing of terrorism; product safety and compliance; transport safety; environmental protection, protection against radiation and nuclear safety; food and feed safety, animal health and welfare; public health; consumer protection; protection of privacy and personal data, and security of networks and information systems; or that affect the financial interests of the European Union or have an impact on the internal market, including infringements of European Union rules on competition and state aid, as well as infringements related to the internal market in connection with acts that infringe corporate tax rules or practices aimed at obtaining a tax advantage that distorts the object or purpose of the applicable corporate tax legislation.

Actions or omissions that may constitute an infringement of the rules or internal procedures implemented by SOCIB, such as fraud risk control, corruption or conflict of interest, or other serious or very serious regulatory compliance risks.

Spanish National Anti-Fraud Coordination Service Channel
Individuals who are aware of behaviors constituting corruption, fraud, conflict of interest, or any irregularity concerning the execution of projects or operations financed wholly or partly with funds from the European Union can report it to the Administration so that the competent authorities may take the appropriate actions in each case, through the specific channel enabled by the Spanish National Anti-Fraud Coordination Service (see Annex to Communication 1/2017, of April 6, on how individuals who are aware of facts that may constitute fraud or irregularity concerning projects or operations financed wholly or partly with EU funds can proceed).
Data Protection
The entity responsible for the processing is the Coastal Observation and Prediction System of the Balearic Islands (SOCIB) with CIF: Q0700535H and address at Parc Bit, Naorte, Bloc A 2nd floor, door 3, Palma, SPAIN. E-07121. Tel: +034 971 43 99 98. The purpose of the processing is to manage the SOCIB's Whistleblower Channel and internal information system. The legal basis for processing is the compliance with a legal obligation. Data will not be transferred to third parties, except under a legal obligation. The processing of data by the person in charge of processing is authorized. No international transfers will be made. The data subject has the right to access, rectify and delete their data, as well as other rights, indicated in the additional information, which can be exercised by addressing the postal address of the responsible entity and/or by email to proteccion.datos@socib.es. Likewise, a complaint can be filed with the AEPD through its website www.aepd.es.
